Abusive Spouse Sentenced to Eight Years for Partner’s Suicide in Scotland

In a historic ruling, Lee Milne, a 40-year-old man from Scotland, received an eight-year prison term for his role in his wife Kimberly’s suicide. The High Court in Glasgow handed down the sentence on Friday, marking the first time in the country a spouse was convicted of being criminally accountable for their partner’s self-inflicted death.

Case Details

Kimberly Milne, 28, died by jumping from a bridge in Dundee on July 27, 2023. She had been married to Lee for 18 months and endured relentless abuse, including physical, emotional, and financial torment. Prosecutors argued that his actions directly contributed to her decision to end her life.

Evidence Presented

The prosecution highlighted incidents where Lee choked, dragged, and punched Kimberly unconscious. CCTV footage captured him shouting at her in a Dundee supermarket the day of her death, while another video showed him swerving his car to avoid hitting her. These acts, combined with his history of locking her in the apartment without food and limiting her access to money, built a case of prolonged control and harm.

“Lee Milne physically and psychologically abused Kimberly Bruce, and our evidence showed that this abuse was a significant contributing factor in her death,” said prosecutor Laura Buchan.

“He deliberately and ruthlessly exploited Kimberly’s vulnerabilities, which makes him culpable for her decision to end her own life,” Buchan added.

Judge Lorna Drummond emphasized that domestic abuse encompasses more than violent acts. “It’s not only about violent acts, it includes more subtle, but nonetheless as harmful, exertions of power and control in a relationship. And it builds over time, each act, whether physical, psychological or financial, adds to the next, increasing pressure and fear, eroding confidence and independence,” she stated.

Family Response

Kimberly’s sister testified that she had encouraged her to leave Lee four months before the incident. However, Kimberly believed Lee would take his own life without her. Despite the breakup, the couple was seen together on the day of her death. Family members present in court described Kimberly as “one in a million” and expressed deep sorrow over her passing.

“By the jury’s verdict, you must bear responsibility not only for all of your abusive acts, but also for causing her death,” the judge concluded.
