The European Court of Justice (ECJ) has determined that individuals who wagered money on online platforms while gambling was prohibited in their home country can still pursue compensation, even if local laws have since been amended. This decision may open the door for others to recover their financial losses under similar circumstances.
A German resident is currently pursuing a claim in domestic courts for damages incurred through online slot machines and lottery prediction bets between June 2019 and July 2021. During that time, gambling in Germany was not legal. The case was challenged in Malta, where the betting company holds a license, and Maltese courts raised three questions regarding EU law to the ECJ for clarification.
Legal Framework and Key Rulings
The ECJ emphasized that online gambling is classified as a service, which typically operates without borders within the EU and the European Free Trade Association (EFTA). However, the court noted that this freedom can be limited to safeguard consumers and maintain social order. It concluded that online betting qualifies for such exceptions, particularly because it carries heightened risks compared to physical betting locations like bookmakers or casinos.
“The freedom to provide services may be restricted for ‘consumer protection and the protection of the social order,'” the ECJ stated.
The court highlighted factors such as the constant availability of online platforms, the player’s anonymity, and the lack of social oversight as reasons for the exemption. It also clarified that Germany’s 2021 legislative change, which legalized online gambling, does not invalidate the original claim. The ruling affirms that EU law does not prevent individuals from seeking restitution for losses sustained during unauthorized betting activities.
This Thursday’s decision could enable other EU citizens, including Germans, to reclaim funds lost on illegal online gambling. The ECJ’s stance sets a precedent for cases where legal frameworks shifted after bets were placed, ensuring that consumers are not left without recourse.
